These Terms of Use constitute a legally binding contract between you and Bikecnc, governing your eligibility to use Bikecnc's websites and applications. By accessing or using our services, you agree to comply with and be bound by these terms.

2. Definitions / General / Conditions

"We," "us," or "Bikecnc" refers to the company providing the platform's services. "You," "lessee," or "lessor" refers to any natural or legal person using our services.

The Bikecnc website is an online platform where users can post, offer, search, and book services. Users who post and offer services are "lessors," and "Lessees" are users who seek, use, or book these services.

We, Bikecnc, are not lessors or users but merely intermediaries between lessors and Lessees ("Users").

Lessors provide scooter rentals. Prior registration through a user account is required. lessors can then list and offer their scooters for rent. The information in your user account must always be accurate. As the operator of the Bikecnc platform, Bikecnc is not the owner, provider, or manager of listings. Bikecnc is not a party to contracts directly entered into between lessors and Lessees. Bikecnc does not act as a lessor, only as an intermediary. If you are a lessor, you are responsible for determining and complying with all laws, rules, regulations, and agreements with third parties that apply to your rental services.

We aim to make your stay in Bali as mobile as possible: Here you can find a variety of providers ("lessors") where you can rent the right bike for your tour. You can also leave a review after using the service or contact the respective lessor directly in advance.

Your Search: During your search, you can look for lessors or a specific bike in the search bar. Additionally, the date, availability, and a selected budget are taken into account. More details can be found in the FAQ.

Booking: When you book a lessor's offer, you agree to pay all fees for your booking, including the rental price offered and any applicable taxes and other items specified during the payment process (collectively, the "Total Price"). Once you receive the booking confirmation, a contract is formed between you and the lessor. In addition to these terms of use, you are subject to all the terms of the booking, including but not limited to the cancellation terms and any other rules, standards, policies, or requirements stated in the lessor's offer or payment process. It is your responsibility to read and understand these rules, standards, policies, and requirements before booking an offer from the lessor.

3. Use of Services

3.1. Eligibility: You must be of legal age to use our services. By using the services, you declare and warrant that you are. For the responsibility of checking valid driver's licenses, the provisions of the respective lessor apply.

3.2. User Accounts: To access certain parts of our services, you may need to create an account. You are responsible for maintaining the confidentiality of your account information and all activities that occur under your account. lessors must create an account to provide their rental, while it is a voluntary option for Lessees. If a user account is created, Lessees can view their personal, editable data and bookings, while lessors manage bookings, list bikes, and set periods and prices. A user account can be deleted independently. Please refer to the cancellation instructions in section 8 Termination.

3.3. Prohibited Activities: You agree not to engage in the following activities:

  • Violation of applicable laws or regulations
  • Infringement of intellectual property rights
  • Distribution or transmission of viruses, malware, or other harmful code
  • Attempting to gain unauthorized access to our systems or networks
  • Harassment, defamation, discrimination, or insults of other users and/or lessors

4. Privacy

Your use of our services is also subject to our Privacy Policy, which you can find at [Privacy Policy Link]. By using our services, you agree to the collection, use, and disclosure of information as described in the Privacy Policy.

5. Content

5.1. User-Generated Content: All content you submit or upload to our services, including text, images, and videos, must comply with our Content Guidelines, which you can find at [Content Guidelines Link].

5.2. Ownership: You retain ownership of your user-generated content. By submitting content to our services, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your content.

6. Cancellation, Complaint, and Booking Changes

6.1. Cancellation:
If a Lessee cancels their booking before the commencement, the respective lessor's cancellation terms apply, which may include various cancellation fees and deadlines.

Full Refund for Non-Appearance: If the rental service does not appear at the agreed time and place, we guarantee a full refund to the customer. This ensures that our customers are not financially affected by circumstances beyond their control.

Refund for Delivery of the Wrong Bike: If the rental delivers a different bike than the one the customer booked, we refund the full amount. We believe in providing our customers with high-quality service and products.

Refund for a Defective Bike: If the delivered bike is defective or not in the promised condition, we refund the full amount. We believe in providing our customers with high-quality service and products.

Refund for Service Interruption: In case of interruptions to the rental service due to reasons such as natural disasters, strikes, or other unforeseen events that prevent the rental from fulfilling its obligations, we guarantee a full refund to the customer. We understand that these are circumstances beyond anyone's control and believe in fair treatment of our customers.

6.2. Changes to Bookings:
lessors and Lessees are responsible for all booking changes made through this platform and agree to pay any additional amounts, fees, or taxes associated with a booking change.

6.3. Termination: We reserve the right to terminate your access to our services at any time and without prior notice, with or without cause.

7. Fees, Taxes, and Payment Methods

7.1. Bikecnc Service Fees:
The service fee helps us provide this platform and service. We collect the service fee when a booking is confirmed. These fees are solely the responsibility of the lessor and currently amount to 10% of the total rental period price, plus any possible transaction fees. We reserve the right to change our service fees at any time and will inform users in advance of any fee changes before they take effect. Any fee changes will have no impact on bookings made before the fee change takes effect.

7.2. Taxes:
Depending on the laws at the relevant location, additional value-added tax may be levied on the above-mentioned fees. If this is the case, the value-added tax is already included in the displayed service fee. Otherwise, Indonesian law applies.

In locations where Bikecnc collects and/or remits taxes on behalf of lessors, you authorize and empower Bikecnc to collect and/or remit taxes on your behalf to the relevant tax authority. Any taxes collected and/or remitted by Bikecnc will be displayed to members in their transaction records. Bikecnc may request additional amounts from members (including by deducting such amounts from future payouts) if the taxes collected and/or remitted are insufficient to fully satisfy the tax obligations of these members. If there are disputes regarding collected taxes or claims for refunds, you must contact the relevant tax authority. We reserve the right to stop collecting and remitting taxes at any location after providing advance notice to affected members.

7.3. Collection and Remittance by Bikecnc:
In the checkout, the Lessee selects from the payment methods (PayPal, credit card, etc.). The price displayed there includes the rental fee for the bike and, if required, a tax. Bikecnc passes on the rental fee to the lessor, without any subletting by us. The intermediary commission mentioned in section 7.1 Bikecnc Service Fees is deducted from the rental price, along with a possible transaction fee. Invoicing to the Lessee is done directly by the lessor, not by us. It is possible to request an invoice from the lessor via the user account and the "X" function.

8. Termination

If you are a lessor and terminate your Bikecnc account, all confirmed bookings will be automatically canceled, and your guests will receive a full refund.

If you terminate your Bikecnc account as a Lessee, all confirmed bookings will be automatically canceled. Any refund depends on the cancellation terms stated in the respective listing. After termination of this agreement, you have no claim to restore your account or content. If your use of the Bikecnc platform is restricted, your Bikecnc account is suspended, or this agreement is terminated by us, you are not allowed to register a new Bikecnc account or use the Bikecnc platform through another member's Bikecnc account.

9. Changes to these Terms of Use

If we make changes to these Terms of Use, we will publish the revised Terms of Use on the Bikecnc platform and adjust the date under "Last Updated" at the beginning of these Terms of Use. We will also notify users of the proposed changes via email before the new Terms of Use take effect. If the proposed changes to these Terms of Use are significant, we will ask you to explicitly agree to the revised Terms of Use.

10. Disclaimer

Our services are provided "as-is" and "as available," without any express or implied warranties.

11. Limitation of Liability

We are not liable for indirect, incidental, special, or consequential damages arising out of or in connection with your use of our services.

Bikecnc is liable according to statutory provisions for intent and gross negligence on the part of Bikecnc, its legal representatives, or other agents. The same applies to the assumption of guarantees or any other non-contractual liability or in the case of culpable violation of life, body, or health. In the event of slight negligence in the breach of essential contractual obligations by us, our legal representatives, or other agents, Bikecnc's liability is limited to the typically foreseeable damage. Essential contractual obligations are those obligations of Bikecnc on whose fulfillment you may rely regularly and may rely. Any further liability of Bikecnc is excluded. To the extent that Bikecnc's liability is excluded or limited, this also applies to the personal liability of legal representatives and other agents.

12. Applicable Law and Jurisdiction

These terms are subject to the laws of Indonesia and shall be interpreted in accordance with them.

If you are a consumer and the mandatory consumer protection regulations of your country of residence contain more favorable provisions for you, these regulations shall apply regardless of the choice of Indonesian law. As a consumer, you may assert claims related to these terms before the competent court at your place of residence as well as before the competent court at Bikecnc's registered office in Indonesia. If Bikecnc wishes to enforce its rights against you as a consumer, we can only do so before the competent courts at your place of residence. If you are acting as a business, you agree to submit to the exclusive jurisdiction of the Indonesian courts.

13. Arbitration Agreement

Arbitration: Any disputes, differences, or claims arising out of or in connection with this agreement or the services provided shall be resolved through arbitration in accordance with the rules and procedures of the Badan Arbitrase Nasional Indonesia (BANI).

The decision of the arbitration tribunal is final and binding on both parties and can be enforced in accordance with applicable laws.

The costs of the arbitration shall be allocated in accordance with the rules of the arbitration organization or the arbitration tribunal.

This arbitration agreement is subject to the laws of Indonesia.

14. Severability Clause / Amendments

Should one or more provisions of these terms be or become wholly or partially invalid, the remaining provisions shall remain in effect. The parties are obligated to replace the ineffective provision or the ineffective part of the provision with a valid regulation that comes as close as possible to the economic meaning and purpose of the ineffective provision or part of the provision.

All amendments and additions to the agreement must be in writing.

15. Miscellaneous

15.1 Google Terms: Some translations on the Bikecnc platform are provided by Google. Google disclaims all express or implied warranties relating to the translations, including all warranties of accuracy, reliability, and all implied warranties of merchantability, fitness for a particular purpose, and non-infringement of third-party rights. Some areas of the Bike platform use Google Maps/Earth map services, including Google Maps interfaces. Your use of Google Maps/Earth is subject to Google Maps/Google Earth's additional terms of use.

15.2 Force Majeure: Bikecnc is not liable for delays or non-performance caused by reasons beyond our control, including but not limited to force majeure, war, terrorism, civil unrest, embargoes, acts of civil or military authorities, fire, floods, accidents, epidemics or diseases, strikes, or a lack of transportation facilities, fuel, energy, labor, or materials.

15.3 Reviews:
Users or renters can review the lessor or bikes after a completed booking and bike return. Similarly, lessors can review the transaction with the renter. The usual terms and etiquettes apply. A review without a prior rental is not possible.
